SC Judge offers to recuse from Amazon and Future case

New Delhi : One of the Supreme Court judges in the three-Judge bench hearing the Amazon and Future case, Justice Hima Kohli, on Thursday said she and her family members hold shares in RIL group companies and offered to recuse if any party or lawyer had objections to her being part of the bench.

The other two judges in the bench include Chief Justice (CJI) Nuthalapati Venkata Ramana and Justice AS Bopanna.

All the lawyers and parties in the case said they had no objection to Justice Kohli hearing the matter. The Apex Court then fixed November 23 for hearing the matter related to Future’s sale of retail assets to the Reliance group. The Apex Court also orally asked the Future group not to proceed with the matter at any other forum till it heard the case.

The Apex Court was hearing the case in connection with a special leave petition (SLP) filed by Future group against the Delhi High Court’s October 29 interim order.

This order denied an application for interim relief on Future Retail’s appeal, seeking a stay on enforcement of the October 25, 2020 Singapore International Arbitration Centre emergency arbitrator award.

Senior lawyer Parag Tripathi appeared on behalf of Future Coupons Pvt Ltd, one of the petitioners in the case before the Supreme Court.
