J&K Admin for strictly adhering to State Emblem of India Act, Rules & Regulations

Jammu : Jammu and Kashmir Administration on Thursday directed officials to strictly adhere to the instructions provided in the State Emblem of India Act, Rules and Regulations.

The circular number 46-JK (GAD) of 2021, read that as per the State Emblem of India (Prohibition of Improper Use) Act, 2005, “No person shall use the emblem for the purpose of any trade, business, calling or profession or in the title of any patent, or in any trademark or design, except in such cases and under such conditions as may be prescribed”.

It has been observed that some individuals/authorities in violation of these elaborate rules/instructions are using the State Emblem on the stationery, vehicles, etc, a matter which has been viewed seriously by the authorities, the circular reads.

“The State Emblem of India is an adaptation of the Sarnath Lion Capital of Ashoka and is the official seal of the Government of India. The Design of the State Emblem of India is provided in the Schedule of the State Emblem of India (Prohibition of Improper Use) Act, 2005, which read with the State Emblem of India (Regulation of Use) Rules, 2007 (read with the State Emblem of India (Regulation of Use) Amendment Rules, 2010) restricts its usage to certain authorities and purposes”, it further reads.

It further reads, “It is accordingly impressed upon all Administrative Secretaries, Divisional Commissioners, Deputy Commissioners, Heads of Departments and Managing Directors of PSUs to strictly adhere to the instructions provided in the State Emblem of India (Prohibition of Improper Use) Act, 2005 and the State Emblem of India (Regulation of Use) Rules, 2007 [read with the State Emblem of India (Regulation of Use) Amendment Rules, 2010) in letter and spirit”.
