SC to hear Sena plea

New Delhi, June 29 (DumaniMail) The Supreme Court will hear on Wednesday evening a plea by the Shiv Sena Chief Whip Sunil Prabhu’s against the Maharashtra Governor’s decision to order a floor test on June 30. The Supreme Court on June 27 declined to pass an interim order on a plea that there should not be any floor test in the legislative assembly till July 11 while protecting 16 rebel Sena MLAs against disqualification proceedings. A Supreme Court bench headed by Justice Surya Kant and comprising Justice J B Pardiwala agreed to hear the matter at 5 pm. Dr Abhishek Manu Singhvi for Prabhu and the ruling Maharashtra Vikas Aghadi (MVA) mentioned the matter.

“I request the Supreme Court to hear it today itself post lunch,” Dr Singhvi said. The floor test has been ordered to be conducted on Thursday. Senior lawyer Neeraj Kishan Kaul, for the Sena rebel group led by Eknath Shinde, argued that the floor test can be conducted as the law is clear in this regard. In the same matter in another development, jailed NCP leaders Anil Deshmukh and Nawab Malik sought direction to attend and vote in Thursday’s floor test. Sena chief whip Prabhu argued that the Governor’s decision to call for a floor test was illegal as he didn’t take into account the Deputy Speaker’s disqualification notices to 16 of 39 rebel MLAs. Prabhu said that none of the 39 MLAs wrote to the Governor withdrawing support to MVA (Maharashtra Vikas Aghadi) government. Prabhu said the Governor called for a floor test after meeting BJP leader Devendra Fadnavis and without seeking the Chief Minister.
